These website Terms of Use (“Terms of Use”) are entered into between you (“you” and “your”) and Records By Mail, LLC (“RBM,” “we,” “us,” and “our”). RBM, ITS DIRECTORS, AND ITS EMPLOYEES WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE OR ANY SITE FOR WHICH IT PROVIDES LINKS, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, PUNITIVE AND CONSEQUENTIAL DAMAGES. RBM’S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ITS CONTENT, REGARDLESS OF THE CAUSE OF ACTION, WILL NOT EXCEED $100.

All matters relating to the Site and these Terms of Use are governed by the laws of the State of New York, without regard to its conflicts of laws principles. Any legal action or proceeding under these Terms of Use will be brought exclusively in the courts located in New York, New York, and you consent to the personal jurisdiction of such courts for such purposes.

If any provision of these Terms of Use is held to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of the remaining provisions.

RBM reserves the right to assign these Terms of Use and all its rights and obligations hereunder, and may do so without notice to you. You may not assign or transfer any of your rights or obligations under these Terms of Use without the prior written consent of RBM.
